- Canada — including additional rights for residents of Quebec.
- European Economic Area (including Germany and Spain), United Kingdom and Switzerland.
- Australia.

How We Collect and Use Your Personal Information
To provide the Services, we collect and have collected over the past 12 months personal information about you from a variety of sources, as set out below. The information that we collect and use varies depending on how you interact with us.
In addition to the specific uses set out below, we may use information we collect about you to communicate with you, provide or improve the Services, comply with any applicable legal obligations, enforce any applicable terms of service, and to protect or defend the Services, our rights, and the rights of our users or others.
What Personal Information We Collect
The types of personal information we obtain about you depends on how you interact with our Site and use our Services. When we use the term "personal information", we are referring to information that identifies, relates to, describes or can be associated with you. The following sections describe the categories and specific types of personal information we collect.
Information We Collect Directly from You
Information that you directly submit to us through our Services may include:
- Contact details including your name, address, phone number, and email.
- Order information including your name, billing address, shipping address, payment confirmation, email address, and phone number.
- Account information including your username, password, security questions and other information used for account security purposes.
- Customer support information including the information you choose to include in communications with us, for example, when sending a message through the Services.
Some features of the Services may require you to directly provide us with certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features.
Information We Collect about Your Usage
We may also automatically collect certain information about your interaction with the Services ("Usage Data"). To do this, we may use cookies, pixels and similar technologies ("Cookies"). Usage Data may include information about how you access and use our Site and your account, including device information, browser information, information about your network connection, your IP address and other information regarding your interaction with the Services.
Information We Obtain from Third Parties
Finally, we may obtain information about you from third parties, including from vendors and service providers who may collect information on our behalf, such as:
- Companies who support our Site and Services, such as Shopify.
- Our payment processors, who collect payment information (e.g., bank account, credit or debit card information, billing address) to process your payment in order to fulfill your orders and provide you with products or services you have requested, in order to perform our contract with you.
- When you visit our Site, open or click on emails we send you, or interact with our Services or advertisements, we, or third parties we work with, may automatically collect certain information using online tracking technologies such as pixels, web beacons, software developer kits, third-party libraries, and cookies.
Any information we obtain from third parties will be treated in accordance with this Privacy Policy. Also see the section below, Third Party Websites and Links.
How We Use Your Personal Information
- Providing Products and Services. We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and other features and functionalities related to your account. We may also enhance your shopping experience by enabling Shopify to match your account with other Shopify services that you may choose to use. In this case, Shopify will process your information as set forth in its Privacy Policy and Consumer Privacy Policy.
- Marketing and Advertising. We may use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or services. This may include using your personal information to better tailor the Services and advertising on our Site and other websites. Where required by law, including in the European Economic Area, the United Kingdom, Switzerland and Quebec, we carry out these activities only with your consent, which you may withdraw at any time. Wherever you live, you can opt out of our marketing communications at any time using the unsubscribe link in our emails or by contacting us.
- Security and Fraud Prevention. We use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately.
- Communicating with You and Service Improvement. We use your personal information to provide you with customer support and improve our Services. This is in our legitimate interests in order to be responsive to you, to provide effective services to you, and to maintain our business relationship with you.
Cookies
Like many websites, we use Cookies on our Site. For specific information about the Cookies that we use related to powering our store with Shopify, see https://www.shopify.com/legal/cookies. We use Cookies to power and improve our Site and our Services (including to remember your actions and preferences), to run analytics and better understand user interaction with the Services (in our legitimate interests to administer, improve and optimize the Services). We may also permit third parties and services providers to use Cookies on our Site to better tailor the services, products and advertising on our Site and other websites.
Consent-based Cookies. If you are located in the European Economic Area (including Germany), the United Kingdom, Switzerland, or Quebec, we place Cookies and similar technologies that are not strictly necessary to operate the Site — including analytics, advertising and profiling technologies — only after you have given your consent through the cookie banner presented to you on your first visit. Strictly necessary Cookies (for example, those that keep items in your cart or secure the checkout) are set without consent because the Site cannot function without them. You can change or withdraw your consent at any time using the cookie preferences control on our Site, and withdrawing consent is as easy as giving it. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.
Most browsers automatically accept Cookies by default, but you can choose to set your browser to remove or reject Cookies through your browser controls. Please keep in mind that removing or blocking Cookies can negatively impact your user experience and may cause some of the Services, including certain features and general functionality, to work incorrectly or no longer be available. Additionally, blocking Cookies may not completely prevent how we share information with third parties such as our advertising partners.
Our website also recognizes the Global Privacy Control (GPC) signal, which enables you to opt-out of certain uses or disclosures of your information. If you notify us of your preference through GPC, we will treat such signal as a valid request to opt out of sharing / targeted advertising for the associated browser or device, and, if we are able to associate the device sending the signal to a Shopify account, we will apply the opt out request to the account as well. To learn more about Global Privacy Control, you can visit https://globalprivacycontrol.org/. Other than the Global Privacy Control, we do not recognize other "Do Not Track" signals that may be sent from your web browser or device.
How We Disclose Personal Information
In certain circumstances, we may disclose your personal information to third parties for contract fulfillment purposes, legitimate purposes and other reasons subject to this Privacy Policy. Such circumstances may include:
- With vendors or other third parties who perform services on our behalf (e.g., IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping).
- With business and marketing partners to provide services and advertise to you. Our business and marketing partners will use your information in accordance with their own privacy notices.
- When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations, with your consent.
- With our affiliates or otherwise within our corporate group, in our legitimate interests to run a successful business.
- In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service, and to protect or defend the Services, our rights, and the rights of our users or others.
We have in the past 12 months disclosed the following categories of personal information and sensitive personal information about users for the purposes set out above in "How we Collect and Use your Personal Information" and "How we Disclose Personal Information":
| Category | Categories of Recipients |

| Category of Personal Information | Categories of Recipients |
|---|---|
| Identifiers such as name, e-mail address and phone number | Business and marketing partners |

Third Party Websites and Links
Our Site may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.
Children's Data
The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.
As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.
Security and Retention of Your Information
Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use insecure channels to communicate sensitive or confidential information to us.
How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide the Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies. In practice, we apply the following criteria:
- Order and transaction records are retained for as long as required by applicable tax, accounting and consumer-law record-keeping obligations.
- Customer account information is retained for as long as your account remains open, and for a limited period afterwards to resolve disputes or enforce our agreements.
- Marketing contact details are retained until you unsubscribe or withdraw your consent, and for a short period afterwards to record and honour your opt-out.
- Customer support correspondence is retained for as long as needed to handle your enquiry and for a reasonable period afterwards.
- Usage Data and Cookie-derived information is retained in line with the retention periods of the analytics and advertising providers we use, and is deleted or anonymised once it is no longer needed for the purpose it was collected for.
If a data breach occurs that is likely to result in serious harm to you, we will notify you and the relevant regulator where the law requires us to do so.
Automated Decision-Making
We do not make decisions about you based solely on automated processing that produce legal effects concerning you or that similarly significantly affect you. We use automated tools, including Shopify's fraud analysis, to flag orders that may be fraudulent, but a member of our team reviews any flagged order before we cancel it or take other action. If you would like more information about how an order was assessed, or wish to contest an outcome, please contact us using the details below.
Your Rights
Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.

Notice at Collection
This Privacy Policy serves as our notice at collection. The categories of personal information we collect, the purposes for which we use each category, the categories of third parties to whom we disclose it, and how long we keep it are described above under How We Collect and Use Your Personal Information, How We Disclose Personal Information and Security and Retention of Your Information. We collect personal information from the sources described in those sections. We do not collect or process sensitive personal information for the purpose of inferring characteristics about you, and we do not sell sensitive personal information.

Depending on your state of residence, you have the rights described under Your Rights above, including the rights to know, access, delete, correct and port your personal information, to opt out of the sale or sharing of your personal information and of targeted advertising and certain profiling, to limit the use of sensitive personal information, to appeal a denial of your request, and not to be discriminated against for exercising any of these rights.
How to Opt Out of Sale, Sharing and Targeted Advertising

Complaints
If you are not satisfied with our response to a request or complaint, California residents may contact the California Privacy Protection Agency or the California Attorney General, and residents of other states may contact their state Attorney General.

This section applies to you if you are located in Canada, and supplements the information set out elsewhere in this Privacy Policy.
Consent
We collect, use and disclose your personal information with your consent, except where the Personal Information Protection and Electronic Documents Act (PIPEDA) or applicable provincial privacy legislation permits or requires us to do so without consent. Depending on the sensitivity of the information and the purpose, your consent may be express (for example, when you opt in to marketing emails or accept non-essential Cookies) or implied (for example, when you place an order and we use your address to ship it). You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting us using the details below — although withdrawing consent may prevent us from providing you with certain products or services.
Storage and Processing Outside Canada
Your personal information is stored and processed outside Canada, including in Australia, the United States, the European Union and other countries where our service providers operate. Cookies and Tracking in Germany
In Germany, § 25 of the Telecommunications Digital Services Data Protection Act (TDDDG) requires your prior consent before we store information on, or access information already stored on, your device, unless doing so is strictly necessary to deliver the service you have requested. We obtain that consent through our cookie banner, and you can withdraw it at any time through the cookie preferences control on our Site.
International Transfers
We are established in Australia and we use service providers located outside the EEA, the United Kingdom and Switzerland, including in Australia, the United States and other countries. Where we transfer your personal information out of the EEA, the United Kingdom or Switzerland to a country that has not been the subject of an adequacy decision, we rely on recognised transfer mechanisms — principally the European Commission's Standard Contractual Clauses, together with the UK International Data Transfer Addendum or the UK International Data Transfer Agreement where relevant — supplemented by additional safeguards where our assessment indicates they are needed. You may request a copy of the safeguards we rely on by contacting us at info@foldifycase.com.
Your Rights and How to Complain
In addition to the rights described under Your Rights above, you have the right to lodge a complaint with a data protection supervisory authority. In Germany, the competent authority is generally the state data protection authority (Landesdatenschutzbeauftragte) for the federal state in which you live, work or where the alleged infringement took place; a directory is maintained by the Federal Commissioner for Data Protection and Freedom of Information at www.bfdi.bund.de. In the United Kingdom, the competent authority is the Information Commissioner's Office at ico.org.uk. In Switzerland, it is the Federal Data Protection and Information Commissioner at www.edoeb.admin.ch. In other EEA countries, you may complain to the supervisory authority of your country of residence.
Providing your personal information for the purposes of completing an order is a contractual requirement: if you do not provide it, we will not be able to process or ship your order.
Additional Information for Users in Spain
If you are resident in Spain, everything above applies to you as an EEA user, supplemented by Organic Law 3/2018 of 5 December on the Protection of Personal Data and the guarantee of digital rights (Ley Orgánica 3/2018, LOPDGDD), which implements the GDPR in Spain.
- Supervisory authority. You may lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, AEPD), C/ Jorge Juan 6, 28001 Madrid, www.aepd.es. You may also bring proceedings before the courts of your place of residence.
- Cookies and tracking. Article 22.2 of Law 34/2002 on information society services and electronic commerce (LSSI-CE) requires your prior consent before we store information on, or access information already stored on, your device, unless doing so is strictly necessary to provide the service you have requested. We obtain that consent through our cookie banner, in line with the AEPD's cookie guidance, and you can withdraw it at any time using the cookie preferences control on our Site.
- Age of consent. Under Article 7 LOPDGDD, a child aged 14 or over may consent to the processing of their own personal data in Spain; below that age, consent must be given by a parent or guardian. Where this Privacy Policy refers to individuals under 16, the Spanish threshold of 14 applies to you instead.
- Exercising your rights. You may exercise your rights of access, rectification, erasure, objection, restriction and portability — together with the digital rights recognised in Title X LOPDGDD — by contacting us at info@foldifycase.com. We respond within one month, which may be extended by up to two further months for complex or numerous requests, and we will tell you if that happens.
Additional Information for Users in Australia
This section applies to you if you are located in Australia, and supplements the information set out elsewhere in this Privacy Policy. We are an Australian business and we handle your personal information in accordance with the Australian Privacy Principles (APPs) set out in the Privacy Act 1988 (Cth).
What We Collect and Why
The kinds of personal information we collect and hold, how we collect and hold it, and the purposes for which we collect, hold, use and disclose it are described above under How We Collect and Use Your Personal Information, How We Disclose Personal Information and Security and Retention of Your Information. We collect personal information only where it is reasonably necessary for our functions and activities as an online retailer. Where it is lawful and practicable to do so, you may deal with us anonymously or under a pseudonym — for example, when making a general enquiry — although we cannot process or ship an order without your name and delivery details.
We do not collect government-related identifiers such as tax file numbers or driver licence numbers, and we do not collect sensitive information as defined in the Privacy Act.
Direct Marketing
We use your contact details to send you marketing communications about our products where you would reasonably expect it or where you have consented. Every marketing message we send includes a simple way to opt out, and you can also ask us to stop at any time by emailing info@foldifycase.com. We will action your request within a reasonable period and at no cost to you. We do not sell your personal information to other organisations for their own direct marketing.
Overseas Disclosure
We disclose personal information to overseas recipients, including our platform, payment, fulfillment, shipping, customer support, email and analytics providers. The countries in which these recipients are likely to be located include the United States, Canada, the United Kingdom, Ireland, Germany and other European Union member states, and Singapore. Before disclosing personal information overseas we take steps that are reasonable in the circumstances to ensure the recipient does not breach the Australian Privacy Principles, including by putting contractual protections in place.
Access, Correction and Complaints
You may request access to the personal information we hold about you, or ask us to correct it, by emailing info@foldifycase.com. We will respond within 30 days. If we refuse your request, we will tell you why in writing and explain how you can complain. There is no fee for making a request, although we may charge a reasonable cost-based fee for giving access in some circumstances, and we will tell you before we do.
If you wish to complain about how we have handled your personal information, please contact us first using the details below and we will respond within 30 days. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au, by phone on 1300 363 992, or by writing to GPO Box 5218, Sydney NSW 2001.
Data Breaches
If we become aware of an eligible data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.
Complaints
If you have complaints about how we process your personal information, please contact us using the contact details provided below. If you are not satisfied with our response to your complaint, depending on where you live you may have the right to appeal our decision by contacting us using the contact details set out below, or lodge your complaint with your local data protection authority. The region-specific sections above set out the authority that applies in the United States, Canada, the European Economic Area, the United Kingdom, Switzerland and Australia.
International Users
Please note that we may transfer, store and process your personal information outside the country you live in, including in Australia, where we are established. Your personal information is also processed by staff and third party service providers and partners in these countries.
If we transfer your personal information out of Europe, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection. Australia has not been the subject of an adequacy decision by the European Commission, and transfers of personal information from the EEA or the United Kingdom to us in Australia are therefore made under those clauses.
